Good Samaritan not put off by a ‘cockroach in the soup’

One of the most popular people stories to come out of the collapse of Arrow Trucking was a Good Samaritan story aired by Amarillo’s NewsChannel 10, KFDA. The Tulsa-based carrier ceased operations suddenly, leaving 1,400 employees and drivers unemployed two days before Christmas. NewsChannel 10’s Dec. 27 newscast told how a trucker unselfishly volunteered to put 200 gallons of fuel in the tank of a truck driven by a former Arrow driver trying to get home.

Such a tale is heartwarming, especially on Christmas Eve. However, it didn’t end there and as facts surrounding the good deed unraveled, it demands that a serious warning message be shared with others.

Let’s back up a bit. OOIDA Life Member Rusty Wade is an owner-operator from Alabama who has been trucking since 1973. Wade, also known as “Yoda,” was following OOIDA’s Facebook initiative to support stranded Arrow drivers when he read about a couple stuck at a truck stop in Stafford, MO. Wade was trucking through Missouri and decided to see if he could help.

“When I first met Frank Davilla, I filled his tanks with fuel,” said Wade. “All I wanted to do was help, and he seemed to need it.”

Davilla (pictured above) told Wade he had worked for Arrow only three months. When he heard operations had ceased, he was in Myrtle Beach. He left the trailer and started bobtailing back toward California – a 3,000 mile trip – with no money and no fuel card.

“Turning the truck in immediately and getting a bus ticket home wasn’t a good option,” said Wade, “as he was traveling with his ‘wife’ and they had a lot of personal belongings and all.”

Both truckers were westbound and trucking the same route from Missouri all the way to California. Wade told Davilla he would add more fuel if needed to get him to the home he claimed to have in Bakersfield.

Wade said while they were snowbound in Joplin, MO, he witnessed Davilla take the tarps and chains and binders off of an Arrow truck that was abandoned there. Wade stayed out of it.

“Frank claimed a right to do this because he said his last check had bounced,” Wade told Land Line.

Later, in Amarillo, Channel 10’s news team learned of Wade’s good Samaritan act back in Stafford. NewsChannel 10 liked the spirit of the Arrow story and how truckers pulled together to get stranded drivers home. A news team went to a truck stop in Amarillo, where they did a “live” evening news segment, featuring Rusty Wade and Frank Davilla.

Wade said his grandfather’s credo of doing right by your fellow man was a code that guided him throughout his trucking career. “All I ask is that the driver that I helped just pay it forward.”

On the NewsChannel 10 news, viewers heard a beholden Frank Davilla vow he would do just that, pay it forward.

But Wade said while they were in Amarillo, he noticed Davilla still selling chains, binders, tarps, etc. in the parking lot. Word of the Arrow shutdown had spread like wildfire, and the generosity of truckers toward their brothers was turning out to be particularly lucrative for Davilla.

“I didn’t mind helping and buying them food and fuel, but the sums of money I saw him take in made my feeding them unnecessary,” said Wade, “so I stopped doing that!”

In addition, Wade said Davilla was “collecting a lot of money” from drivers who wanted to help an Arrow driver.

Wade said Davilla and his “wife” got into an argument over that because she thought he should have used some of that money to help the other former Arrow drivers they met along the way. Wade said he eventually learned that the woman Davilla called his wife was in fact a girlfriend.

“I just wanted to help those drivers in trouble get home,” said Wade, who says he plans to take the whole thing in stride. “All in all, everyone who gave those former Arrow drivers a hand did an extraordinary job. Davilla is a cockroach in the soup, a bad apple, and he’s fighting against forces much more powerful than he can understand at this point in his life. I will pray for him to survive the lessons he will learn.”

More to the story

Frank Davilla called OOIDA on Tuesday, Jan. 12, for help. He told the Association he was “delivering in Canada” when Arrow shut its doors, was detained for several days at the border, was forced to sell everything on his truck for fuel money and had only made it as far as Bakersfield. He said he owned the truck via lease-purchase. He needed to get “home to Missouri to his wife” and could we please, please loan him some money? He said he had not received a dime from anyone so far, but he was just going to have to swallow his pride now and ask for help.

He asked for a loan, but OOIDA’s not in the loan business. We do, however, have a finance department, and one of our members had notified us he was out of trucking and had left a trailer in Bakersfield. OOIDA had financed the trailer, and we needed to bring it back to Missouri. Bakersfield? Hey, that’s where Frank was. Missouri? That’s where Frank wanted to go.

If Frank could prove he was an Arrow driver, we were willing to give him a job.

We asked him to fax something from Arrow with the truck number on it. He did. We then forwarded his name and truck number to the “Arrow volunteers” so they could confirm he was a driver. They did. Frank even gave us his date of birth and license number. Everything looked good.

We told him if he wanted to bring the trailer back for us, we would pay for fuel, food and lodging. We told him we would pay a few hundred on top so he could have some money for bills when he got home. He enthusiastically agreed and seemed genuinely appreciative. So we wired him some money for fuel, parts (he said he sold the air hoses and electrical lines) and money to pay the trailer storage.

He was supposed to check in on Jan. 15, but that didn’t happen. He finally called Jan. 18 and said he was unable to get the trailer. It was agreed that he would return some of the money; in fact, he was going to run across the street to Western Union and wire it straight away. He would call us right back with the control number.

That was Jan. 18.

We’ve still received no money back. Frank’s cell phone is “not currently accepting calls.”

We’ve since found out the Social Security number he gave us was bogus, and the guy has an old rap sheet a mile long in Kern County, CA.

OOIDA does not regret any of the help the Association or its members have extended to former Arrow drivers. We’ve been helping drivers in one way or another since 1973. We will keep on doing that. And we’ll continue to report on the bankruptcy and provide important post-employment information to those who need it.

But if you run across this man in your travels, be wary and watch your wallet. He is quick with a lie and may seem convincing, but if you dig around, things clearly don’t add up.

Shame on you, Frank Davilla.

  9. Mr. wade, you are my kind of trucker, but I am truly sorry you got taken by these two. This was an expensive lesson, but don't you forget it. When dealing with any body you don't know, proceed with caution, don't give such a large amount right off the bat. There is an old saying; you can't judge a book by it's cover.I don't agree.Yes sir I have been had also, but never by more than 10 bucks. You see, always leave a little for the next person to do. At Simmons Truck Stop on 95 in Va. A lady came to me and said here car was broke down just south of the truck stop and she was trying to get some money so she could get herself and her two kids something to eat. I gave her 7 bucks. When I went in to pay for my fuel, the lady at the desk asked me if I had given that woman any money? I said yes. She pointed to the porker machines. There she was, putting my hard earned money in a gambling machine. Like yourself, I will still help any person in need, but slowly.

They were told to dead head to chicago area to pick up their next load, roflmao. Im sorry Mr. Wade. I was still in contace w/ the girlfriend as of 4 days ago..I had no clue this was going on. I had my questions about him but I thought Sue Ann was a "good girl", I had no clue Frank was such a blatant liar. They told me that a news crew was documenting their journey back to Bakersfield, that they were going to send a copy of the show to them on dvd and that Dan Rather was producing it...guess i was taken for a ride too... :(

  19. The picture posted looks like the same Frank Davilla who supposedly owns Leather Outlaw Productions and has a listing and picture on Myspace. This sounds like the same guy too. I sent $150.00 to him for vendor fees for the Bakersfield Poker Run scheduled in August of 2009. I was notified on my way to the event that it had been canceled. Six months later I still have not received my money from Frank Davilla.

U see when I heard about u being stranded my husband and I were in Springfield and were willing to help yall with food being we are tight on money as well even though he is also a truck driver. Came away, homeless, with no wheels, but out of debt.

  37. Frank, Frank, Frank –

You put my name in your post so now I feel compelled to respond. I have, up until this point, remained silent regarding my communications with you because I didn’t really have anything nice to say. I still don’t have anything nice to say, but I’m going to say it anyway….

You did call me yesterday. Very interesting conversation. You apologized and said the right things, but the truthfulness in your comments is questionable at best. I won’t go into the details here, but I’m sure you know which comments were truthful and which were not.

Yoda has every right to forgive you, Frank. And it doesn’t surprise me that he did because he is a good man. But if you are looking for forgiveness from me, you are looking in the wrong place. I can’t absolve you. I can’t give you forgiveness that is not mine to give. You didn’t steal from me, you stole from this Association. You stole from your fellow truckers. You stole from my friends and the members I work for. It’s their place to forgive you or not. Not mine.

My personal feelings on the subject are that you have done nothing at this point to earn any forgiveness from anyone. You have apologized and said you will pay us all back. Big deal. While that may be a step in the right direction, it doesn’t change anything. Your actions need to match your words, Frank. The ball is in your court. Show us you deserve to be forgiven -- don’t tell us. Believe me, we’ve all heard enough.

you are a sad head case frank. all of us truckers and trucker wives just try to stay ahead to make a buck in the industry and here you are stealing from guys that really need it. i feel sorry for you when all these truckers do find you. you tell ooida you will pay them back but, like my truckin hubby says actions speak louder than words, and yes he work for arrow years ago and we have lost everything to the industry before but trucking is not a job it is a lifestyle. you need some serious help, you are truly a scumbucket

  41. I think its pretty sad that you had to result to scamming other drivers and good people to better yourself. My husband was stranded in Washington state for a month after Arrow pulled this crap. We lost our apartment, our boys had no Christmas and we damn near lost our car. But you know what, we weren't out scamming people so please don't whine and cry about your "debt". A real man wouldn't have scammed a fellow driver, he would have gotten out there and found another job and helped other people. I have a part time job and was supporting 4 people but I found the money to help out other Arrow drivers. I just hope you know that karma is a b*tch and soon enough you will get yours.

  42. As someone who has been on both sides of the fence, (both a driver and a Driver Manager), I have had my shares of ups and downs. When I heard Arrow went under I was shocked. I havent worked for them since 2004. I have a few words for Mr. DaVilla myself..

    Frank, youre an idiot.

I recently lost my job in January. I am a father to a 15 year old son, and I am not out stealing from people to make ends meet. I have managed to keep my wits about me. You say no one else understood where you were.. B.S. there were another 1000 drivers in the same boat with you!!

Then there were those of us who UNDERSTOOD, and answered to the call to arms to help our fellow truckers. (I may not be driving anymore but I will still help when needed).

I hope you have changed, (gee not sure thats gonna be believable with the other stuff youve pulled on bike runs, and your "promotor" myspace page) You have a lot of soul searching to do (if you even have one), I suggest you do that and get yourself right, because if not, there are quite a few people who are willing to "get you right" if youre not.

  45. Frank, your MySpace page is ridiculous. You list yourself as having a baccalaureate in Criminal Justice from Bakersfield College, and belonging to Lambda Lambda Lambda Fraternity.

Bakersfield College is a community college and doesn't offer a BA or BS in Crim Justice or Corrections Admin. http://www.bakersfieldcollege.edu/academic/degrees/ . You sure got the BS from somewhere, eh? ;-)~ Are you sure you weren't an inmate in Bakersfield, and paid your dues in AdSeg?

Tri-Lam only has two chapters in the country. They are both on the East Coast. Are you sure you didn't spend time in 'Corrections Admin' somewhere in CT or Buffalo? I understand that the 'Correctional Fraternity' runs towards the 'Greek' thingy, especially with the protracted absence of sorority sisters. http://en.wikipedia.org/wiki/Lambda_Lambda_Lambda unless you mean the frat from 'Revenge Of The Nerds'.

You list promoter as your occupation; I'll venture that beside yourself, the only thing you promote is the steering wheel holder du jour, and your 'wife'.

While I doubt I've shamed you, I sincerely hope I've insulted you. If I've put a pucker of mitigated indignation in your asshole, the few minutes I've spent on you here have not been wasted.

    Karma is real Frank.

Good id good, bad is bad. You seem to be on the wrong path to a real satisfying life. Is it realy so fun where you are? Are you really getting anywhere with your current beliefs?

  53. Jesus said to pray...

Our father who art in heaven Hallowed by "Thy name", "Thy kingdom" come, "Thy will" be done, on earth as it is in heaven on earth as it is in heaven. Forgive US OUR trespasses as we forgive those who trespass against us.

Thinking that through... Frank, I forgive you... YODA...

  54. Words are words to this puke of a human being! He wants no more than to skate through life on someone elses paycheck or good deeds! He is no better than the lowlifes who say they are god fearing reformed felons being let out of prison! Nothing will ever change, you are better just to move on and give it up to learned BUT NOT Forgotten!

  55. Good Samaritan laws are laws or acts offering legal protection to people who give reasonable assistance to those who are injured, ill, in peril, or otherwise incapacitated. In some cases, Good Samaritan laws encourage people to offer assistance. The protection is intended to reduce bystanders' hesitation to assist, for fear of being sued or prosecuted for unintentional injury or wrongful death. See the link below for more info.
